We recognize the importance of privacy and the sensitivity of personal data and information shared to us via our website namely www.simplifi.my (“Personal Data”) and we are extremely committed to the protection of the Personal Data in line with the Personal Data Protection Act 2010 (“PDPA”).

1. Privacy Policy

This privacy policy applies when you use our website namely www.simplifi.my ("Service"). This privacy policy may be supplemented by additional privacy statements, terms or notices provided to you.

Simplifi.my is the primary controller of the Personal Data provided to, or collected by or for, the Service.

We will indicate within the registration processes of our services and other registration forms what types of personal information are required and those that are requested. You may choose not to submit the requested information, but that may limit or prohibit the services that Simplifi.my is able to provide to you.

2. Data Collected

Data and information are collected based on your input.

We deem that all Personal Data involving third parties shared whilst using the Service are consented by the relevant parties. Where you disclose to us any Personal Data of any third party, you hereby represent, undertake and warrant that for any Personal Data of the third party that you will be or are disclosing to us, that you would have prior to disclosing such Personal Data to us obtained the appropriate consent from the third party whose Personal Data are being disclosed, to:

  1. Permit you to disclose the third party’s Personal Data to us for the purposes stated hereinunder; and/or

  2. Permit us and our related companies to collect, use, disclose and/or process the third party’s Personal Data for the purposes stated hereinunder.

We shall not be held liable in any circumstances whatsoever to the Personal Data of a third party that we have collected based on your input.

3. Data Provided

The types of Personal Data that we collect directly from you depends on how you interact with us and the Service, which may include:

  1. Name, National Registered Identity Card (NRIC) number, passport number, contact information including address, email address and phone number, details of the property involved, details in relation to the sale and purchase of the property, details of the financiers and loans applied for in relation to purchase of property;

  2. Statuses of the property and financing transaction; and

  3. Such other relevant information and data to enable us to provide you with the Service.

4. How Data Is Used 

We use the Personal Data provided to us to: 

  1. Provide, activate and manage your access to and use of the Service; 
  2. Update end clients on the status of their respective transaction; 
  3. Provide a live update to you and end clients on the status of their respective transaction on Simplifi.my; 
  4. Ensure the privacy of each of end clients is protected and cannot be easily accessed by public; 
  5. Provide technical, product and other support and to help keep the Service working, safe and secure; 
  6. Respond to your requests, inquiries, comments and concerns; 
  7. Notify you about changes, updates and other announcements related to the Service and our other products and services; 
  8. Deliver targeted advertisements, promotional messages, notices and other information related to the Service and your interests; and 
  9. Provide you with promotional messages and other information about products, events and services of ours, our affiliates and third parties such as sponsors. 
  10. Maintenance and upkeep of internal client records, administration, management, business development, advertising, continuous professional development, education, research, internal operations, troubleshooting, data analysis, testing, statistical and survey purposes, professional network, employment and social activities; and 
  11. For any other purpose that is incidental or ancillary or in furtherance to the above purposes. 

You shall give us a notice in writing as soon as reasonably practicable should you be aware that third party has withdrawn such consent as set out in Section 2. Without prejudice to our other rights under law and/or the agreement(s) between yourselves and us, upon the receipt by us of the said notification, we shall have the right to discontinue or not provide any of our services that are linked to such Personal Data; and 

5. Disclosure of Personal Data 

The Personal Data provided to Simplify.my will generally at all times be kept confidential but you hereby consent and authorise Simplify.my to provide or disclose the Personal Data to the extend it is required to the following categories of parties: 

  1. Any persons, government agencies, statutory authorities and / or industry regulators where we are compelled to disclose the Personal Data pursuant to any law or regulation;
  2. Our affiliates, partners, third parties, service providers, representatives and agents, who may be located within or outside Malaysia, for the Service; 

  3. Our auditors, consultants, accountants or any relevant financial institutions or professional advisers; 
  4. Our suppliers, contractors, sub-contractors or third party service providers as may be deemed to be necessary or appropriate; 
  5. Any permitted assigns; and/or 
  6. Our successors in title. 

Further to the above, we also will disclose the Personal Data if we have a good faith belief that such disclosure is necessary to: 

  1. Where necessary to provide the Service, fulfil a transaction or otherwise perform a contract with you or at your request prior to entering into a contract; 
  2. Where necessary for our compliance with applicable law or other legal obligation; 
  3. Where necessary for the performance of a task carried out in the public interest; 
  4. Where necessary to enable our customers to comply with their legal obligations; 
  5. Where applicable, with your consent; and/or 
  6. Where necessary to operate our business, protect the security of our systems, customers and users, detect or prevent fraud, except where our interests are overridden by your privacy rights. 

Where we rely on your consent and your warranties on the consent given y the relevant third party to process the Personal Data, you have the right to withdraw your consent at any time, and where we rely on legitimate interests, you may have the right to object to our processing. 

6. Safeguards and Protection of Data 

Simplify.my shall keep and process the Personal Data in a secure manner and prevent any unauthorized and/or unlawful processing, any accidental loss, destruction or damage to the Personal Data. We shall use our best endeavour to execute the appropriate administrative and security safeguards and procedures in accordance with the PDPA to protect and safeguard the integrity of the Personal Data. This section shall be extended to all third parties stated in Section 5 above that may have the access to the Personal Data. 

7. Data Retention 

We retain the Personal Data for as long as necessary to provide the Service and fulfil the Service you have requested, or for other essential purposes such as complying with our legal obligations, maintaining business and financial records, resolving disputes, maintaining security, detecting and preventing fraud and abuse, and enforcing agreements entered by the users. 

8. Accessing and Updating Data

  1. Your Account  - The Service may allow registered users to directly access and review their account information and make corrections or updates upon login at any time. Keeping such information up to date is the responsibility of the user. Registered users may also close their account directly through the Service or by contacting the Service’s customer support. 
  2. Your Rights - You have the right to request: 
    • access to your personal information and the Personal Data; 
    • rectification or removal of the Personal Data given by you; 
    • restriction of our processing of the Personal Data, or to object to our processing; and 
    • portability of the Personal Data. 

9. Changes 

We will update this privacy policy from time to time. Any changes will be posted on Simplify.my with an updated revision date. If we make any material changes, we will provide notice through the Service or by other appropriate means. 

10. Payments 

Unless otherwise specified, Simplify.my processes any payments by credit card, bank transfer or other means via external payment service providers. In general and unless stated otherwise, users are requested to provide their payment details and personal information directly to such payment service providers. Simplify.my shall not be involved in the collection and processing of such information.
